Heritage Registry Division

Introduction

The Heritage Registry Division (HRD) is the division that carries out the functions of the Commissioner according to the provisions and requirements of the National Heritage Act 2005 [Act 645], namely the determination and registration of sites, objects and underwater cultural heritage as heritage. In addition, the HRD also plays a role in publicizing any heritage details and any Living Persons declared by the Minister of Tourism, Arts and Culture as National Heritage. In line with this function, this section is divided into two (2) main sections: The Gazette Section and the Enforcement Section. Registering heritage details is an important goal to establish and legally protect the country's heritage records. An assessment to determine the significance and authenticity of any item must be made to ensure the integrity of an item that is designated as heritage.


Any details with very high heritage value will be proposed to the Minister of Tourism, Arts and Culture to be gazette as National Heritage. To ensure the gazettement process can be carried out regularly, the Gazette Section is responsible for conducting research and assessments of natural sites, geological sites and tangible objects. The purpose of the investigation and assessment is to determine which items on the inventory/nomination list have heritage significance and authenticity for consideration by the Expert Committee for recommendation to the Heritage Commissioner. After the heritage items are gazette and recorded in the National Heritage Register, the Enforcement Section is responsible for carrying out control and monitoring to ensure that heritage sites are always in good condition and heritage objects are stored in good condition in a safe place.


Any application for permission designed at heritage sites and National Heritage sites must comply with the provisions of Section 40, National Heritage Act 2005. In addition, this Section is also responsible for conducting investigations for prosecution purposes if any offenses occur under the provisions of the National Heritage Act 2005. The Enforcement Section is also responsible for evaluating and processing all license applications under the National Heritage Act 2005, namely licenses for excavating heritage objects, exporting and importing foreign items, salvaging and excavating underwater cultural heritage and heritage item dealers. Therefore, to ensure understanding and compliance with the National Heritage Act 2005, the Heritage Registry Division provides advice and lectures to any party in need from time to time.
